Terms of Service

These Terms and Conditions ("Terms") govern your use of the Estatio website, services, and any related interactions with Estatio ("we," "us," or "our"), a family-run construction company based in Sheffield, South Yorkshire, specialising in premium residential renovations. By accessing our website, submitting surveys, requesting reports, or engaging our services, you agree to these Terms. If you do not agree, please do not use our services.

These Terms are in addition to any specific contract for services (e.g., JCT Home Owner contracts). In case of conflict, the service contract prevails.

1. Our Services

We provide project management and construction services for residential upgrades, including loft conversions, garage conversions, home offices, open-plan living conversions, conservatory conversions, single-story extensions, and dormer additions. Services are delivered via vetted subcontractors under our oversight.

- Lead Generation and Reports: Our website and Meta ads may offer free personalised PDF reports based on survey responses. These are informational only, not quotes or advice, and generated using automation tools (e.g., GoHighLevel, n8n, OpenAI API).

- Quotes and Contracts: Quotes are provided after consultations and are valid for 30 days. All work requires a signed contract (e.g., JCT standard form), outlining scope, timelines, and payments.

- Subcontracting: We act as principal contractor; subcontractors are qualified (e.g., NICEIC for electrics, Gas Safe for gas). We remain responsible for overall quality.

Services are subject to availability and may require site visits, planning permissions, or building regulations compliance under UK laws (e.g., Building Regulations 2010).

2. Payments and Pricing

- Quotes: Prices include materials, labor, subcontractor fees, and our management fee. VAT applies if turnover exceeds £90,000 (current threshold); we are not currently VAT-registered.

- Payment Terms: Staged via JCT contracts: 20% deposit upfront, 50% during milestones (e.g., prep complete, structure up), 30% on completion (with optional 5% retention released after 3 months if defect-free). Payments due within 7–14 days of invoice; late payments incur 8% interest under the Late Payment of Commercial Debts Act 1998.

- Methods: Bank transfer or card (2–3% fee for cards).

- Refunds/Cancellations: Deposits are refundable under Consumer Rights Act 2015 if we cancel or breach. Client cancellations after work starts may forfeit deposit and incur costs for work done.

3. Client Obligations

You agree to:

- Provide accurate survey information for reports.

- Grant site access and comply with safety requirements.

- Obtain necessary permissions (e.g., planning for extensions >30m²).

- Pay invoices on time.

4. Liability and Warranties

- Our Liability: We warrant work complies with UK standards (e.g., workmanship 1–5 years, IBGs for defects). Liability is limited to project value for direct losses; no consequential damages (e.g., lost income). We are not liable for subcontractor delays if communicated promptly.

- Force Majeure: No liability for events beyond control (e.g., weather, supply shortages).

- Insurance: We hold Public Liability (£2M), Professional Indemnity (£250k), and Contract Works insurance. Clients should maintain their property insurance.

- Disclaimers: PDF reports are general advice, not guarantees. Mock-ups/visuals are illustrative; final results may vary.

5. Intellectual Property

PDF reports, designs, and website content are our property. You may use reports for personal purposes but not reproduce or share without permission.

6. Termination

We may terminate services for non-payment or breach, with notice. You may terminate per contract terms, subject to costs incurred.

7. Dispute Resolution

Disputes resolved under English law, with mediation first (e.g., via FMB). Courts of England and Wales have jurisdiction.

8. Changes to Terms

We may update Terms; changes posted here. Continued use implies acceptance.
